ZuperAp Private Limited is the data controller for the personal data collected through this Platform.

ZuperAp is a Platform, bringing together buyers on one side and sellers on the other side, Service Providers on one side and Service Consumers on the other side. We have job providers on one side and job seekers on the other side, Matrimony Providers on one side and Matrimony seekers on the other side, those who are renting out and those who are hiring, those who are looking for friends/buddies/co-founders and those seeking friends / buddies / co-founders. We work as Platform as a Service (PaaS).

We are just a platform for business transactions. We are actually not selling any products /services. We are only using the Payment Gateway to collect Platform Usage Charges as Subscription. We will also be providing options for customers to pay directly to service providers and sellers of products.

Subscription
  • Subscription is not compulsory for buying products, availing services, getting jobs, renting apartments / houses or hiring vehicles for ZuperAp users. You can even find a friend or a buddy or a life partner or a co-founder for your entrepreneurial venture. You can send your business card with your contact and location details to your friends and acquaintances. For all these activities ZuperAp users do not need subscription. ZuperAp will not be responsible for negative Comments / Reviews on ZuperAp by Users.
  • However, if you want to use ZuperAp for promoting your business, like selling products, offering services, getting employees, or renting out vehicles / properties / belongings or to identify a partner or a co-founder, you can avail the 90-day free subscription plan initially. After 90 days, you can opt for either Rs.120/- per month or Rs.999/- per year subscription plan and continue promoting your business
  • Your ZuperAp Subscription will continue until terminated. To use the ZuperAp service, you must have Internet access and a ZuperAp ready mobile phone / laptop.
  • You may provide us with one or more Payment Methods. You will be notified before your billing date, so that you can decide on the renewal of the subscription and choose the right subscription plan.
  • ZuperAp does not sell any products / services. We are just a platform for business transactions. We are not responsible for the products and services provided by third parties. However, using the Reviews / Comments in the Business page of sellers, buyers can validate the seller and his products / services and take the right decision.

Billing and Cancellation
  • The length of your billing cycle will depend on the type of subscription that you choose when you signed up for the service. You can sign up for ZuperAp using your account with a third party as a Payment Method. You can find the billing information about your ZuperAp Subscription by visiting ‘My Account’.
  • Payment Methods: To use the ZuperAp for promoting your business, you must provide one or more Payment Methods.
  • Updating your Payment Methods: You can update your Payment Methods by going to the ‘My Account’ page. We may also update your Payment Methods using information provided by the payment service providers.

Passwords and Account Access
  • The member who created the ZuperAp account (the "Account Owner") is responsible for any activity that occurs through the ZuperAp account.
  • To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the ZuperAp ready devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, ZuperAp or our partners from identity theft or other fraudulent activity.
  • Warranties and Limitations on Liability. The ZuperAp service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or mandatory consumer protection rights that apply to you. We are only a platform that brings buyers and sellers together. Transaction is only between seller and buyer. To help the buyer ascertain the quality of sellers, we have included a section called “Comments / Reviews”. If you are a business owner who has taken subscription of ZuperAp for selling products or providing services, it is your responsibility to provide good quality products and services and to ensure that you receive the payments from the buyers. ZuperAp will not be responsible for getting payments from buyers for products and services sold by you through ZuperAp. ZuperAp will not be responsible for negative Comments / Reviews on ZuperAp by Users.
  • Class Action Waiver. WHERE PERMITTED UNDER THE APPLICABLE LAW, YOU AND ZuperAp AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, where permitted under the applicable law, unless both you and ZuperAp agree otherwise, the court may not consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

Miscellaneous
  • Governing Law.
    These Terms of Use shall be governed by and construed in accordance with the laws of the Country.
  • Your Responsibility.
    You are fully responsible for the decisions that You made to use Application, Services, Third-Party Content, Offers or Payment Method. You shall treat the Service Provider, Third-Party Content Provider, Offers Provider, and Payment Method Provider respectfully and shall not engage in unauthorized, threatening or harassing behaviours when using Services, Third-Party Content, Offers or Payment Method. You are fully responsible for any loss and/or claim arising from the use of the Application, Services, Third-Party Content, Offers or Payment Method using Your Account, either by You or other parties who use Your account, in a manner that is contrary to this Terms and Use, Privacy Policy, including the terms and conditions and privacy policy set forth by the Service Provider, Third-Party Content Provider, Offers Provider and Payment Method Provider, or applicable laws and regulations, including but not limited to the purposes of anti-money laundering, anti-terrorism financing, criminal activities, fraud in any form (including but not limited to phishing and/or social engineering activities), violations of intellectual property rights, and/or other activities that are harmful to the public and/or any other parties or are considered damaging to Our reputation.
  • Limitation of Our Responsibility
    We provide Application as is and We do not represent or warrant that the reliability, timeliness, quality, suitability, availability, accuracy, completeness or security of the Application and will fulfil Your needs and suffice Your expectations, including but not limited to Services, Third-Party Content, Offers and Payment Method which are fully under the Service Provider, Third-Party Content Provider, Offers Provider and Payment Method Provider’s responsibilities. We shall not be responsible for any loss or damage caused by any failure or mistake of the Service Provider, Third-Party Content Provider, Offers Provider or Payment Method Provider or Your failure or mistake in complying to Our, Service Provider, Third-Party Content Provider, Offers Provider or Payment Method Provider’s Terms of Use. Application may experience limitations, delays, and other issues contained in the use of internet and electronic communications, including Your, Service Provider, Third-Party Content Provider, Offers Provider or Payment Service Provider’s device is broken, not connected to the internet, out of range, turned off or not functioning. We are not responsible for any delay, failure of delivery, damage or loss arises from such problems. However, We still supervise to ensure smooth uses of the Application and to ascertain compliances with this Terms of Use, applicable laws and regulations, court orders, and/or administrative institutions or other government bodies requirements. We do not have any responsibility, including to take further actions or legal actions deemed necessary by You, Service Provider, Third-Party Content Provider, Offers Provider or Payment Method Provider, for any problem or dispute arises between You and the Service Provider, Third-Party Content Provider, Offers Provider or Payment Method Provider. We are providing ‘Comments / Reviews’ option under every seller of Products or Services for you to take the right decisions. Please validate ‘Comments / Reviews’ before buying products or availing services. ZuperAp will not be responsible for negative Comments / Reviews on ZuperAp by Users.
  • Actions We Consider Necessary
    If We know or have sufficient reasons to suspect that You have committed immoral acts, violations, crimes or other actions that is in contrary with this Terms of Use and/or applicable law, whether or not referred to in this Terms of Use, then We have the right to and may suspend Your Account, either temporarily or permanently, or stop Your access to Application, including Services, Third-Party Content, Offers and/or Payment Method contained therein, investigate, claim compensation, report to authorized parties and/or conduct other actions that We consider necessary, including criminal and civil law proceedings. We will conduct investigations and/or facilitate the concerned Service Provider in reporting to the authorized party if We receive Reports of any violations You committed against this Terms of Use or violations to the applicable laws and regulations, with respect to:
  1. Verbal harassment or violence, including but not limited to, physical, gender, ethnicity, religion and race You conducted toward the Service Provider or User.
  2. Physical harassment or violence you conducted toward the Service Provider or User; and/or
  3. Sexual harassment or violence, either verbally or physically, you conducted toward the Service Provider or User.

This provision applies vice-versa when You experience the same violences mentioned above by the Service Provider.

Your statement

    ZuperAp requires everyone to be at least 13 years old before they can create an account (in some jurisdictions, this age limit may be higher). Creating an account with false info is a violation of our terms. This includes accounts registered on the behalf of someone under 13. If You do not meet those conditions but still access or use the Application, Services, Third-Party Content, Offers or Payment Method, You represent and warrant that Your act of signing up, accessing or conducting other activities within the Application have been approved by Your parents, guardians or custodian. You expressly waive any rights under the applicable laws to cancel or revoke any and all consents You provided according to this Terms of Use when You are deemed legally mature.

    You agree to access or use the Application, Services, Third-Party Content, Offers and Payment Method solely for the purpose as specified in this Terms of Use and not to abuse or use the Application, Services, Third-Party Content, Offers or Payment Method for fraudulent purposes, causing inconvenience to others, requesting fake orders or other actions that may or may be deemed to cause losses in any form toward other people. You understand and agree that all risks arising from the use of the Application, Services, Third-Party Content, Offers and Payment Method are entirely Your responsibility and You hereby agree to release Us from any claims regarding damages, interferences or other forms of system disruptions caused by unauthorized access by other parties.

    You expressly release Us, including but not limited to Our officials, directors, commissioners, employees, and agents, from any and all obligations, consequences, material or immaterial losses, claims, fees (including advocate fees) or legal responsibilities that arise or may arise due to Your violation of this Terms of Use, or in connection with the Service Provider, Third-Party Content Provider, Offers Provider or Payment Method Provider’s behaviours.

    Excluded from the foregoing, if there is a direct loss due to Our violation of thIs Terms of Use, then You agree and expressly limit the amount of Your claim as to the total amount actually incurred or paid in connection to the event.

    YOU ACKNOWLEDGE THAT WE ARE A TECHNOLOGY COMPANY, NOT A TRANSPORTATION, LOGISTIC, FINANCIAL, RETAIL, SERVICE, MANPOWER, CONSTRUCTION, INVESTMENT, RESIDENTIAL AND OTHER COMPANY AND WE DO NOT PROVIDE TRANSPORTATION, LOGISTIC, FINANCIAL, RETAIL, SERVICE, MANPOWER, CONSTRUCTION, INVESTMENT, RESIDENTIAL AND OTHER SERVICES. ALL TRANSPORTATION, LOGISTIC, FINANCIAL, RETAIL, SERVICE, MANPOWER, CONSTRUCTION, INVESTMENT, RESIDENTIAL AND OTHER SERVICES ARE PROVIDED BY INDEPENDENT THIRD P ARTIES THAT ARE NOT EMPLOYED BY US.

    BY CONTINUING ACCESS OR USE TO THE APPLICATION AND/OR SERVICES, YOU HEREBY AGREE TO SUBJECT TO AND COMPLY WITH ALL OF THIS TERMS OF USE, INCLUDING ALL OF ITS AMENDMENTS AND TERMS OF USE OF EACH SERVICE PROVIDER, THIRD-PARTY CONTENT PROVIDER, OFFERS PROVIDER OR PAYMENT METHOD PROVIDER. IMMEDIATELY STOP TO ACCESS OR USE THE APPLICATION AND/OR SERVICES IF YOU DO NOT AGREE TO ANY PART OF THIS TERMS OF USE.

    ZuperAp does not accept unsolicited materials or ideas for ZuperAp content and is not responsible for the similarity of any of its content in any media to materials or ideas transmitted to ZuperAp.

Customer Support

    To find more information about our service and its features or if you need assistance with your account, please visit the ZuperAp ‘Help Center’ on our website. In the event of any conflict between these Terms of Use and information provided by Customer Support or other portions of our website, these Terms of Use will control.

Survival

    If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

Changes to Terms of Use and Assignment

    ZuperAp may, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you. We may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.

    We will send you information relating to your account (e.g., payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.

What Personal Information do we collect about you?

    Data provided through direct interactions:

    We collect information you provide to us which includes: Registration and other account information such as your name, gender, date of birth, phone number, email address, personal and official address or postal code, current location, hometown, payment method(s), education, qualification, profession, designation, hobbies, areas of interest, Work experience, Work Locations, Working time, Company / Organisation and Specializations. We collect this information in several ways, including when you enter it while using our service, interact with our customer service information when you choose to provide ratings, taste preferences, account settings, listing details (including preferences set in the "My Account" section), or otherwise provide information to us through our service or elsewhere.

    Information we collect automatically: We collect information about you and your use of our service, search queries, your interactions with us and our advertising. This information includes your activity on the ZuperAp, your interactions with our emails and texts, and with our messages through push and online messaging channels; details of your interactions ith our customer service, such as the date, time and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number and call recordings.

    Information from other sources: We also obtain information from other sources. We protect this information according to the practices described in this Privacy Statement, plus any additional restrictions imposed by the source of the data. These sources vary over time, but could include: service providers that help us determine a location based on your address in order to customize our service and for other uses consistent with this Privacy Statement; security service providers who provide us with information to secure our systems, prevent fraud and help us protect the security of Super App accounts; payment service providers who provide us with payment or balance information, or updates to that information, based on their relationship with you; publicly-available sources such as publicly available posts on social media platforms.

    Validation of your ZuperAp account: We validate the accounts of ZuperAp users by using SMS/Email verification within India and Email verification elsewhere to ensure that each account is associated with a real and unique user. This process is entirely free of charge.

    If you do not agree to validate your account, then your account will not be activated.

    If you do not agree to validate your account, then your account will not be activated.

    Once you have validated your ZuperAp account, it will remain associated with the mobile number/Email used for the SMS/Email verification. If you wish to change the mobile number associated with your ZuperAp account you will need to contact our Customer Support team. For closing an account you can go to Menu bar and click on Account cancellation.

    Communication through the chat feature on our Platform: When you use our chat feature to communicate with other users, the information remains secure.

Why do we process your personal information?

    We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

    Where we need to perform the contract, we are about to enter into or have entered into with you; Where it is necessary for our legitimate interests to improve our Services and to provide you a safe and secure Platform; Where we need to comply with a legal or regulatory obligation; In certain circumstances, we may also process your personal data based on your consent. If we do this, we will let you know the purpose and the category of personal data to be processed at the time we seek your consent.

    We use information to provide, analyse, administer, enhance and personalize our services and marketing efforts, to manage member referrals, to process your registration, your orders and your payments, and to communicate with you on these and other topics.

    We have set out below a description of the reasons for which we use your personal data, [and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate].

For providing access and delivering

    Services through our Platform:: If you log in using your mobile number or email id, we use your first name and last name, mobile number and/or e-mail address to identify you as a user and provide access to our Platform.

    We use third party payment service providers to process any payment you make for our Services. Depending on the method of payment, you may be requested to provide us with your payment and credit card details which we will then provide to the payment service provider in order to process your payment. We do not store your credit card information, unless you choose the option to save such information. We do not store any credit card code verification values and merely forward such values and your credit card number in an encrypted manner for the purpose of processing your payment by our payment service provider.

    We process the above information for adequate performance of our contract with you. For improving your experience on the Platform and developing new functionalities of the Platform.

    When you choose to provide us with your location data, we use your location data for following purposes: to enhance the performance of our Services and to personalise the content we direct towards you. For example - with the help of location data we display ad listings which are in your vicinity to improve your buying experience. For this purpose, Google Maps is integrated into our Platform. This means that both Google and we are responsible for the processing of your location data in the context of Google Maps. In any case, we will not process your location data for any other purposes but those explained in this Privacy Statement. However, Google might process such location data for their own purposes as explained in the Google Privacy Policy which can be reviewed Your use of Google Maps through our Platform is subject to Google Maps’ Terms of Service.

    To measure and monitor your interaction with the third-party advertisements banners we place on our Platform.

    With the help of your account information which includes your email ID and phone number, we map the different devices (such as desktop, mobile, tablets) used by you to access our Platform. This allows us to associate your activity on our Platform across devices and helps us in providing you a seamless experience no matter which device you use.

    We use the images you upload, the descriptions and prices you provide in your ad listings to train machine learning models to personalize search results in relation to ad ranking and user interest, to improve the identification and presentation of ad listings, to improve the search function and to increase the likelihood of a successful sale. This helps us to improve our Services and to provide you with a better user experience.

    We process the above information for adequate performance of our contract with you and on the basis of our legitimate interest to improve your experience of our Services.

    To provide you a safe and secure Platform: We use your mobile number, log data and unique device identifiers to administer and protect our Platform (including troubleshooting, data analysis, testing, fraud prevention, system maintenance, support, reporting and hosting of data). If you think that your account was wrongfully banned, you can contact us through our customer support helpline in which case our team will review the decision to ban your account.

    To promote and offer you Services that may be of your interest: We process the above information on the basis of our legitimate interest in undertaking marketing activities to offer you Services that may be of your interest. Specifically, you may receive certain marketing communications from us:

    • .by any preferred means of communication, if you have requested such information from us;
    • .by email, regarding similar products and services, if you already use our Services or acquired some of our products;
    • .by phone or email, if you provided us with your details when you entered a competition; or
    • .by phone or email, if you registered for a promotion.

    You can ask us to stop sending you such marketing communication at any time by contacting the customer support.

    We may amend and update this privacy statement from time to time. We will notify you of material changes to this privacy statement as appropriate under the circumstances and as required by applicable laws, e.g. We will communicate with you by email, SMS or in-App notification or in-App message in connection with our Services/Platform. If you do not agree with the way we are processing your personal data and the choices we are providing to you, you may close your account at any time by going into your account settings and select delete account.

    We will communicate with you by email, SMS or in-App notification or in-App message in connection with our Services/Platform to confirm your registration, to inform you in case your ad listing has become live / expired and for other transactional messages in relation to our Services. As it is imperative for us to provide you such transactional messages you may not be able to opt -out of such messages.

Who do we share your data with?

    We may have to share your personal data with the parties set out below for the purposes set out in section 3 above.

    Corporate affiliates:We may share your data with our group companies which are located within as well as outside India and help us in providing business operation services such as product enhancements, customer support and fraud detection mechanism.

    Third Party Service Providers: We use third party service providers to help us deliver certain aspects of our Services for example, cloud storage facilities.

    We conduct checks on our third-party service providers and require them to respect the security of your personal data and to treat it in accordance with the law. We do not allow them to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

    Law enforcement authorities, regulators and others: We may disclose your personal data to law enforcement authorities, regulators, governmental or public bodies and other relevant third parties to comply with any legal or regulatory requirements.

    We may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy statement.

    Publicly available information: When you post an item for sale using our Services, you may choose to make certain personal information visible to other ZuperAp users. This may include your first name, last name, your email address, your location, hometown, current location, education, qualification and your contact number. Please note, any information you provide to other users can always be shared by them with others so please exercise discretion in this respect.

    Security: Measures to safeguard your personal information against loss, theft and unauthorized access, use and modification. These measures are designed to provide a level of security appropriate to the risks of processing your personal information.

    We will update this Privacy Statement from time to time in response to changing legal, regulatory or operational requirements. We will provide notice of any such changes (including when they will take effect) in accordance with law. Your continued use of the ZuperAp service after any such updates take effect will constitute acknowledgement and (as applicable) acceptance of those changes. If you do not wish to acknowledge or accept any updates to this Privacy Statement, you may cancel your use of the ZuperAp service. Where do we store your data and for how long?

    The data we collect about you will be stored and processed in secure servers in order to provide the best possible user experience. For example – for fast website or mobile application build up.

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

    To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Technical and organisational measures and processing security

    All the information we receive about you are stored on secure servers and we have implemented technical and organisational measures that are suitable and necessary to protect your personal data. ZuperAp continually evaluates the security of its network and adequacy of its internal information security program which is designed to (a) help secure your data against accidental or unlawful loss, access or disclosure, (b) identify reasonably foreseeable risks to the security of the ZuperAp network, and (c) minimize security risks, including through risk assessment and regular testing. In addition, we ensure that all payment data are encrypted.

    Please note, despite the measures we have implemented to protect your data, the transfer of data through the Internet or other open networks is never completely secure and there is a risk that your personal data may be accessed by unauthorised third parties.

    We collect certain information from and in relation to the electronic device from which you are accessing our Services on the basis of our legitimate interest in preventing fraud on our Services. The information we collect includes your user ID (depending on whether you are logged in), ZuperAp country domain, device language settings and time zone. To promote and offer you Services that may be of your interest.

Refund / Cancellation Policy

Cancellation.

    You can cancel your ZuperAp Subscription at any time, and you will continue to have access to the ZuperAp service through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial Subscription periods

    To cancel, go to the "My Account" page and click on ‘Account Cancellation’. If you cancel your Subscription, your account will automatically close at the end of your current billing period.
